Hazards and Hazardous Materials <br /> <br />The Project site has a history of contamination from the site’s former use as <br />an auto repair facility and a dry cleaner and from the nearby gas station which <br />stores petroleum in underground storage tanks.81 The Project may remain <br />contaminated by hazardous materials and is listed on the Geotracker site (Cortese <br />list),82 which states83: <br /> <br />The Phase II investigations indicate groundwater in the vicinity of the Site <br />contains low levels of total petroleum hydrocarbons as diesel. Shallow soil <br />samples collected at the Site had reported low levels of total petroleum <br />hydrocarbons as diesel and motor oil and various metals; pesticides and lead <br />were detected exceeding risk-based screening levels. Soil gas samples <br />collected off-site exceeded commercial or residential risk-based screening <br />levels for volatile organic compounds including benzene, tetrachloroethene, <br />ethylbenzene, naphthalene and chloroform; soil gas samples collected on-Site <br />exceeded commercial or residential risk-based screening levels for volatile <br />organic compounds including benzene, tetrachloroethene, ethylbenzene, <br />naphthalene, chloroform and vinyl chloride. The primary chemicals of <br />potential concern identified during investigations conducted to date include <br />volatile organic compounds (VOCs), lead, pesticides, and petroleum. <br /> <br />The Checklist fails to disclose the Project site’s Cortese listing, and fails to <br />disclose the existing contamination described on the Geotracker website. As <br />SWAPE explains, the State Geotracker’s description of contamination at the Project <br />site is entirely inconsistent with the Checklist’s conclusion that “the project site <br />does not contain outstanding surface or subsurface recognized environmental <br />conditions that require further investigation.”84 Absent mitigation, disturbance of <br />contaminated soil during Project construction may release contaminants which <br />could pose significant health and safety risks to workers and sensitive receptors <br />near the Project site. This is a more significant impact than analyzed in the <br />General Plan EIR, and is not disclosed in the Checklist, resulting in violations of <br />CEQA’s disclosure requirements.
