3 <br /> <br />project site does not contain outstanding surface or subsurface recognized environmental conditions <br />that require further investigation” (p. 4‐63). <br />The Geotracker website includes a March 2021 PowerPoint presentation2 that describes active and <br />ongoing investigations and includes these bullet points: <br /> 14th & Callan Street Developer, LLC entered into an agreement with Alameda County <br />Department of Environmental Health to oversee investigation and cleanup activities to support <br />site redevelopment. <br /> Additional investigation will be conducted in March to further define the extent of chemicals in <br />soil and soil vapor <br /> Proposed Remedial Action <br />o Excavating shallow soils across the site <br />o Targeted deeper excavation as needed <br />o Transporting excavated soil to a licensed disposal facility, if needed, or re‐use as fill on <br />site <br />o Backfilling excavations with clean, imported fill, as needed <br /> Proposed Mitigation <br />o Installation of engineered systems beneath occupied building and along utility trenches. <br /> <br />None of this is disclosed in the Checklist, and the agreement with the Alameda County Department of <br />Environmental Health is not attached. Instead, the Checklist states there are no Geotracker sites within <br />a 1,000 feet, when, in fact, the Project site itself is a Geotracker site undergoing active investigation and <br />cleanup under Alameda County Department of Environmental Health oversight. <br />This is problematic for two reasons: <br />1. CEQA requires the disclosure of all sites listed on the Cortese list (i.e. Geotracker cleanup sites), <br />and prohibits CEQA exemptions for sites on the Cortese list. The Checklist fails to disclose the <br />Cortese‐list status of the Project site and fails to provide adequate disclosure of the status of the <br />site as undergoing further environmental investigation and, ultimately, cleanup. <br />2. The impacts of the investigation and the cleanup are not disclosed. The Checklist fails to <br />disclose, among other cleanup impacts: <br />o How contaminated soils will be handled and stored to protect neighboring residents and <br />businesses from exposure to contaminated vapors emanating from the soil. <br />o How contaminated soils will be trucked through the surrounding neighborhoods in a safe <br />manner, including dust protection, and the routes to be taken by the disposal trucks. <br />o The construction emissions of remediation equipment that will be required (excavators, <br />loaders, trucks for hauling contaminated soil, trucks for workers involved in the assessment <br />and cleanup) and health risks that will be incrementally added to the construction emissions <br />that were disclosed. <br /> <br />Absent mitigation, disturbance of contaminated soil during Project construction may release <br />contaminants which could pose significant health and safety risks to workers and sensitive receptors <br /> <br />2 RO3472_FCT_SHT_2021‐03‐02.pdf (ca.gov) <br />118
