6. Prior to issuance of any Certificate of Occupancy on the property, the <br />improvements outlined above shall be completely installed to the satisfaction of <br />the Community Development Director and the City Engineer. <br />IV. PROJECT SITE IMPROVEMENTS <br />1. Screened Utilities. All electrical, gas, and water meters shall be located such that <br />they will not be visible from the streets, or these units shall be screened or <br />enclosed. <br />2. Mechanical Screening. All exterior mechanical equipment such as air <br />conditioning/heating units and radio/television antennas shall be screened from <br />view so as not to be visible from adjacent properties or streets to the satisfaction <br />of the Community Development Director. This condition shall not apply to <br />wireless cable receivers that do not exceed three feet in diameter. <br />3. Signage. All signage shall conform to the regulations in Chapter 4.12 of the <br />Zoning Code. Neon signs and flashing signs are prohibited on the property, <br />including those placed in windows. All signs on the property shall be well <br />maintained. Damaged signs shall be promptly repaired or replaced. <br />4. Access. Public access consistent with the requirements of the original Bay Fair <br />TOD Specific Plan adopted February 20, 2018, as demonstrated on Exhibits W <br />and Y, shall be maintained in perpetuity and shall not be gated or fenced such <br />that the public can no longer access areas marked "Public Pedestrian Access <br />Easement" or "Public Access Easement\EVAE" on Tentative Parcel Map No. <br />11120. <br />5. Paved Surfaces. Paved surfaces for parking and circulations shall not cover <br />more than 30% of the total site area and parking areas shall be 50% or more <br />shaded by tree canopies at maturity per the original Bay Fair TOD Specific Plan <br />adopted February 20, 2018. <br />6. Driveway Aprons. The applicant shall remove driveway aprons no longer <br />necessary to serve the proposed development and replace them with City <br />standard sidewalk, curb, and gutter per San Leandro Municipal Code §5-1-405. <br />V. INCLUSIONARY HOUSING <br />1. Inclusionary Housing Plan. Applicant/Property Owner shall comply with Zoning <br />Code Section 6.04.128.13 Inclusionary Housing Plan prior to building permit <br />issuance. The Inclusionary Housing Plan shall show how the project will comply <br />with the requirements of the City's Inclusionary Housing Ordinance, contained in <br />Zoning Code Chapter 6.04, including the affordability requirements in Zoning <br />Code Section 6.04.112(B). <br />2. Inclusionary Housing Agreement. Prior to the issuance of a building permit, the <br />Applicant/Property Owner shall execute an Inclusionary Housing Agreement (i.e. <br />a regulatory agreement) restricting the rental of all affordable units in the project <br />in accordance with the Density Bonus Law and Inclusionary Housing Ordinance <br />(Zoning Code Chapter 6.04).
