(1) The following provisions of this Ordinance may be enforced beginning on January <br />1, 2022: Section 3-24-400 concerning Requirements for Commercial Business <br />Generators, Section 3-24-500 concerning Waivers for Commercial Business <br />Generators, Section 3-24-800 concerning Requirements for Haulers and Facility <br />Operators, Section 3-24-900 concerning Requirements for Self -Haulers, and <br />Inspections related to compliance with those sections. <br />(2) The following provisions of this Ordinance may be enforced beginning on January <br />1, 2024: Section 3-24-300 concerning Requirements for Single Family Generators, <br />Section 3-24-600 concerning Requirements for Commercial Edible Food <br />Generators, and Section 3-24-700 concerning Requirements for Food Recovery <br />Organizations and Services, and Inspections related to compliance with those <br />sections. <br />(3) The Enforcement Agency will monitor compliance with this Ordinance through <br />Compliance Reviews, Route Reviews, investigation of complaints, and an <br />Inspection program (that may include Remote Monitoring). <br />(4) The Enforcement Agency may issue a Notice of Violation requiring compliance <br />within 60 days of issuance of the notice. <br />(5) Absent compliance by the respondent within the deadline set forth in the Notice of <br />Violation, the Enforcement Agency shall commence an action to impose penalties, <br />via an administrative citation and fine, pursuant to the Enforcement Agency's <br />standard procedures. <br />(d) Penalty Amounts for Violations. <br />The penalty levels are as follows: <br />(1) For a first violation, the amount of the penalty shall be $50 to $100 per violation or <br />such higher amount as may be established by the Enforcement Agency. <br />(2) For a second violation, the amount of the penalty shall be $100 to $200 per violation <br />or such higher amount as may be established by the Enforcement Agency. <br />(3) For a third or subsequent violation, the amount of the penalty shall be $250 to $500 <br />per violation or such higher amount as may be established by the Enforcement <br />Agency. <br />(e) Compliance Deadline Extension Considerations. <br />The Enforcement Agency may extend the compliance deadlines set forth in a Notice of <br />Violation issued in accordance with this Section if it finds that there are extenuating <br />circumstances beyond the control of the respondent that make compliance within the <br />deadlines impracticable, including the following: <br />
