The designated <br />areas include the following: <br />2.8.1 HVAC/Air Conditioners. The areas containing the HVAC, including, but not limited <br />to, concrete pads, air conditioning condensers, and related equipment, are Exclusive Use Common Areas <br />reserved for the exclusive use of the Occupants of the Unit served by the equipment. <br />2.8.2 Loading Area. The loading area identified as “_____” on the Condominium Plan <br />is reserved for the exclusive use of the Owner and Occupants of Unit 1. The loading area identified as <br />“_____” on the Condominium Plan is reserved for the exclusive use of the Owner and Occupants of Unit 2. <br />2.8.3 Parking Spaces. The parking spaces identified “___” through “___” on the <br />Condominium Plan are reserved for the exclusive use of the Owner and Occupants of Unit ___. The parking <br />spaces identified “___” through “___” on the Condominium Plan are reserved for the exclusive use of the <br />Owner and Occupants of Unit ___. <br />2.8.4 Rooftop Equipment Area. The rooftop areas containing rooftop equipment are <br />reserved for the exclusive use of the Owner and Occupants of the Unit served by the rooftop equipment, <br />provided that it is installed in compliance with the requirements of this Declaration. <br />2.8.5 Signage and Lighting Fixtures. The areas containing signage and lighting fixtures <br />that are located on the Condominium building, including, but not limited to, signs, awnings, lighting fixtures, <br />and related equipment, are Exclusive Use Common Areas reserved for the exclusive use of the Occupants <br />of the Unit served by the signage and lighting. <br />2.8.6 Solar Use Areas. The solar use areas, if any, described in Section 3.12.1(iv) are <br />Exclusive Use Common Area appurtenant to the Unit(s) to which they are assigned. <br />2.8.7 Trash Collection Areas. The trash collection area identified as “_____” on the <br />Condominium Plan is reserved for the exclusive use of the Owner and Occupants of Unit 1. The trash <br />collection area identified as “_____” on the Condominium Plan is reserved for the exclusive use of the <br />Owner and Occupants of Unit 2. <br />2.9 Restrictions on Partition. Except as authorized in Sections 2.6, 8.7 and 8.9, the Common <br />Area shall remain undivided, and there shall be no judicial partition thereof except as may be authorized <br />under Section 8.9 or by Civil Code section 6656 or any successor statute thereto. <br />Any proceeds or property resulting from a partition shall be distributed to and among the respective <br />Owners and their Mortgagees as their interests appear in proportion to the ratio that the fair market value <br />of each Owner’s Condominium bears to the fair market value of all Owners’ Condominiums as of the date <br />immediately preceding the date of the event giving rise to the right of the Owners to partition the Common <br />Area, provided that any proceeds for Exclusive Use Common Areas shall be disbursed to the Condominium <br />entitled to use the Exclusive Use Common Areas before the sale or taking. <br />ARTICLE 3 <br />Restrictions <br />3.1 Uses. The Condominiums may be used only for commercial purposes that are permitted <br />by Applicable Laws. Restaurant uses requiring grease interceptors or venting systems are permitted <br />subject to all Applicable Laws. Food services where the food is prepared off site or without the requirement <br />of a venting system or grease interceptors are authorized in any Condominium. No commercial uses may <br />be conducted in a Unit until the Owner of such Unit complies with all permit, licensing and other Applicable <br />Laws.
