any on -site work that would restrict trucks to arterial streets that have sufficient pavement section <br />to bear the heavy truck traffic, thereby minimizing noise and traffic impacts to the community. Such <br />plan shall include all plans for temporary signals, temporary signage, temporary striping, location <br />points for ingress and egress of construction vehicles on and off the site, staging areas, and timing <br />of construction activity which appropriately limits hours during which large construction equipment <br />may be brought on or off the site. <br />24. Prior to issuance of permits for any on -site work west of Monarch Bay Drive, the <br />Applicant/Developer shall submit a spill contingency plan pursuant to Mitigation Measure HYDRO- <br />1B and shall demonstrate that Mitigation Measure HYDRO-1A is satisfied as it relates to the <br />Applicant/Developer's scope of work. <br />25. Prior to issuance of permits for any on -site work east of Monarch Bay Drive, the <br />Applicant/Developer shall submit a Monarch Butterfly Roosting Habitat Protection Program <br />(MBRHPP) prepared by a qualified biologist that complies with EIR Mitigation Measure BIO-1A and <br />ensures adequate avoidance and protection of the winter roosting colony, consistent with the <br />intent of Section 4-1-1000, Interference with Monarch Butterflies Prohibited, of the San Leandro <br />Municipal Code. Grading and equipment operation, any tree removal, pruning, or herbicide <br />application within 200 feet of the edge of trees known to support the Monarch Butterfly Roosting <br />Habitat shall be restricted from August 1 through March 31 to prevent any inadvertent disturbance <br />to the winter roosting colony, unless modified by the approved Monarch Butterfly Roosting Habitat <br />Protection Program (MBRHPP). <br />26. Prior to issuance of permits for any on -site work east of Monarch Bay Drive in the vicinity of the <br />jurisdictional wetlands, a compensatory mitigation program shall be developed and implemented <br />to provide adequate mitigation for jurisdictional waters affected by proposed improvements per <br />Mitigation Measure BIO-3 and HYDRO-113 The jurisdictional wetland delineation shall be prepared <br />by a qualified wetland specialist and submitted for verification by the Army Corps. As appliable, a <br />Wetland Protection and Replacement Program (WPRP) shall be prepared by the qualified wetland <br />specialist shall be reviewed and approved by regulatory agencies and implemented accordingly. As <br />applicable, a Section 404 permit shall be obtained from the Army Corps and a Section 401 water <br />quality certification shall be obtained from the RWQCB. <br />27. Prior to issuance of permits for any on -site work, the Applicant/Developer shall submit a Mitigation <br />Measure Compliance Checklist confirming compliance with all required environmental mitigation <br />measures contained in the Mitigation Monitoring and Reporting Program. <br />Prior to Tree Removal <br />28. A tree report shall be prepared and submitted for approval. Such report shall indicate: <br />a. Trees to be removed and those to be preserved. <br />Measures to protect trees to be preserved shall be incorporated into and demonstrated on <br />all applicable plans, including installation of temporary construction fencing at the perimeter <br />of the protected area, restrictions on construction within the fenced areas unless approved <br />as a condition of the application and performed under the supervision of the certified <br />arborist, and prohibition on parking or storing of vehicles and other construction equipment <br />within the protected area. <br />Recommended Conditions of Approval June 21, 2022 <br />PLN22-0008, PLN21-0020 & PLN21-0021 Page 6 of 39 <br />
