IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO.2022-105 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO AUTHORIZE THE CITY MANAGER TO EXECUTE A NON-PROFESSIONAL SERVICES AGREEMENT WITH LIND MARINE, INC. FOR REMOVAL AND DISPOSAL OF 15 BOATS AND FOUR (4) BOAT TRAILERS FROM THE SAN LEANDRO MARINA IN AN AMOUNT NOT -TO -EXCEED $99,500; AND TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE CUMULATIVE CHANGE ORDERS UP TO 25% OF THE ORIGINAL CONTRACT AMOUNT WHEREAS, a draft agreement between the City of San Leandro and Lind Marine, Inc. was presented to this City Council; and WHEREAS, Change Orders to modify bid quantities or to respond to unexpected conditions are a normal aspect of public contracting; and WHEREAS, Lind Marine, Inc. has agreed to the terms of the contract pending Council approval; and WHEREAS the City Council is familiar with the contents of the agreement; and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City of San Leandro City Council hereby RESOLVES as follows: That said agreement substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and That the City Manager is authorized to negotiate and approve cumulative change orders up to a maximum of 25% of the original contract amount, or $24,875; and That $99,500 will be re -appropriated from the FY 2021-2022 to the FY 2022-2023 budget from Account 597-57-177-5890, and That an original executed agreement shall be attached to and made a part of this resolution.
