SAN LEANDRO SHORELINE DEVELOPMENT EIR ADDENDUM PROJECT <br />CITY OF SAN LEANDRO <br /> <br />May 2022 Page 61 <br />4.18 TRIBAL CULTURAL RESOURCES <br />4.18.1 IMPACTS ASSOCIATED WITH THE MODIFIED PROJECT <br />a) Would the project cause a substantial adverse change in the significance of a tribal cultural resource, <br />defined in Public Resources Code section 21074 as either a site, feature, place, cultural landscape <br />that is geographically defined in terms of the size and scope of the landscape, sacred place, or object <br />with cultural value to a California Native American tribe, and that is: <br />Environmental Issues <br />Substantial <br />Change in <br />Project <br />Requiring <br />Major <br />EIR/MND <br />Revisions <br />Substantial <br />Change in <br />Circumstanc <br />es Requiring <br />Major <br />EIR/MND <br />Revisions <br />New <br />Information <br />Showing <br />New or <br />Increased <br />Significant <br />Effects <br />Less Than <br />Significant <br />Impacts/No <br />Changes or <br />New <br />Information <br />Requiring <br />Preparation <br />of a <br />Subsequent <br />EIR/MND No Impact <br />i) Listed or eligible for listing in the <br />California Register of Historical Resources, or <br />in a local register of historical resources as <br />defined in Public Resources Code section <br />5020.1(k), or <br /> x <br />ii) A resource determined by the lead <br />agency, in its discretion and supported by <br />substantial evidence, to be significant <br />pursuant to criteria set forth in subdivision <br />(c) of Public Resources Code Section 5024.1. <br />In applying the criteria set forth in <br />subdivision (c) of Public Resource Code <br />Section 5024.1, the lead agency shall <br />consider the significance of the resource to a <br />California Native American tribe. <br /> x <br /> <br />Background: <br />2022 Appendix G Threshold <br />The CEQA Checklist Guidelines for Tribal Cultural Resources were added since those used for the Certified <br />EIR of the Original Project. <br /> <br />Comments: <br />TRIB-i, ii. <br />The 2015 Certified EIR was prepared before the 2019 updated CEQA checklist addition of analysis on <br />Tribal Cultural Resources. However, criteria a) was addressed in Chapter 4.4, Cultural Resources for the <br />Original Project, as described in the Certified EIR, and was reduced to a less than significant impact <br />through implementation of Mitigation Measure CULT-1.
