the date of the conditional approval of this Project. If you fail to file a protest within this <br />90-day period, complying with the requirements of Government Code Section 66020, you <br />will be legally barred from later challenging any such fees, dedications, reservations or <br />other exactions. <br />B. Design review fees, permit fees, inspection fees, and any other fees charged by the City or <br />other reviewing agencies for the review, approval, permitting and inspection of the public <br />improvements shall be paid by the Applicant. <br />C. Prior to the issuance of Building Permits, the property owner shall pay the Park Facilities <br />Development Impact Fee (As of 7/l/04 $3,820 for one Residential Unit), Development <br />Fee for Street Improvements (DFSI) (As of 7/l/04, $939 for one Residential Unit), Sewer <br />Connection fee and other fees as required by City Ordinances and regulations. <br />D. Site Improvement Plans for all on -site and off -site improvements shall be prepared by a <br />Registered Civil Engineer and approved by the City Engineer prior to the issuance of <br />Building Permits for the project. All improvements shall be designed and constructed in <br />accordance with the City's Design Standards, Specifications and Standard Plans, unless <br />otherwise specifically approved by the City Engineer. <br />E. Applicant shall remove any broken and uplifted sidewalk, curb and gutter along the full <br />project frontage and shall construct new City standard sidewalk, curb and gutter in the <br />same location and alignment as the existing curb and gutter. <br />F. The three additional parking spaces proposed along the northeast portion of the lot shall <br />be maintained as compact parking spaces and the aisle width shall be a minimum of 20 <br />feet. All other parking spaces shall be maintained as standard spaces. <br />G. Prior to the issuance of building permits for the project, the Applicant shall obtain an <br />Encroachment Permit from the Engineering and Transportation Department for any work <br />within the public right-of-way. <br />H. If the design of any site improvements requires encroachments onto neighboring <br />properties during construction, written agreements with that property owner shall be <br />submitted to the City Engineer, for review and approval, prior to issuance of the building <br />permits. <br />I. The Applicant shall comply with the provisions of the City's Grading Ordinance and <br />the Urban Runoff Clean Water Program. The City requires a grading permit any time <br />more than fifty (50) cubic yards of material is moved. The Ordinance requires that an <br />erosion control and sediment plan be prepared, submitted and approved by the City <br />prior to issuance of a Grading Permit. <br />J. Construction activity shall not commence prior to 7:00 a.m. and shall cease by 7:00 p.m. <br />Monday through Friday, and construction activity shall not commence prior to 8:00 a.m. <br />Conditions of Approval November 15, 2004 <br />PLN2004-00084; 244 Harlan Page 4 of 6 <br />
