Eden Road was on <br />some of the properties along it; taxes had not been paid since 1966 or earlier; and the ownership <br />of the property was not known. <br />Member Grazzini asked if the tires and other rubble shown in the photos had been placed by the <br />Applicant or by others. <br />Mr. Guss stated that debris was dumped after the site was closed, such as, tires, cars, and <br />appliances. He stated that he stockpiled it until there was enough to take to Waste Management <br />next door. He claimed that his dumping bill for last month was $2,000. <br />Sheila Sanders, 20993 Foothill Boulevard, Hayward, employee of C & G Contractors, stated <br />that she went to the recorder's office to ascertain the owner of the Eden Road area. She agreed <br />with Planner Pollart's comments. <br />Chair Marr asked if the Applicant was in communication with A. Zietz, who was listed as the <br />property owner. <br />Mr. Guss stated that he believed the Mr. Zietz was deceased. He stated that he originally <br />entered into an agreement with Howard Ransom, President of Galbraith Country Club. He now <br />paid rent to Monica Russell, a granddaughter of Mr. Zietz. <br />Chair Marr opened the public hearing. <br />Ms. Sanders asked that the whole nature of the C & G Contractor's business (its dedication to <br />recycling and its community involvement) be taken into consideration. She felt that the <br />Applicant, by doing the "larger thing, at whatever cost," and taking it upon himself to dispose of <br />refuse dumped by others, should be considered. She asked the Board to look at what was <br />working, as opposed to what the Board considered was not working. <br />Mr. Guss stated that the General Manager of the San Leandro Rifle and Pistol Range asked Mr. <br />Guss to leave his card with the Board and asked that any interested person call him for a <br />reference. He also noted many contributions made to the community by his company. <br />Lou Filipovich, 15376 Laverne Drive, asked if the process had been changed, because the Chair <br />did not ask for speakers who approved or disapproved of the matter. He stated that approving or <br />disapproving of the company and its community involvement had nothing to do with this <br />hearing. This was an issue of compliance and all the information needed to make the decision <br />was in the final nine pages of the report. In his opinion, the City had done everything possible <br />under the law to ensure compliance with the CUP and its efforts had been ignored. He did not <br />believe that the City of Oakland, the City of San Leandro, the State and the County would ever <br />decide who owned the property. <br />Motion to Close the Public Hearing <br />(GrazzinilSidari; 6 Ayes, 0 Noes; Absent — Shields) <br />
