Excerpts of Board of Zoning . _ _, _ vents Special Meeting <br />Minutes No. 2002-15 <br />July 18, 2002 <br />Page 4of 5 <br />Member Eliason stated that she was a member of the Board in 1996 and the issues had not <br />changed. Who owned the property was interesting, but had it nothing to do with the issue before <br />the Board. She would support revocation of the Use Permit. <br />Member Sidari stated that he was the other member of the Board in 1996 and asked if the City <br />of San Leandro had the right to act on the use of the property. <br />Planner Pollart stated that the Assessor's Office indicated that Albert Zeitz was the property <br />owner. However, this property was within the city limits of the City of San Leandro. <br />Assistant City Attorney Goldfien clarified that the property was within the City of San Leandro <br />and was subject to compliance to the permit conditions issued by the City. Property ownership <br />was not before the Board, as noted by Member Eliason. <br />Member Sidari stated that, because no one within the City had monitored the site after 1997, the <br />Board had to rely on the documents included in the staff report dated before 1997 and it seemed <br />that nothing had changed. <br />Planner Pollart stated that he was correct. When staff initially met with Ms. Saunders last year, <br />the same issues were brought up, such as the request that the Applicant apply for a grading <br />permit. There had been no response from the Applicant. <br />Member Goldt stated that, when reviewing the documentation, the company's track record had <br />not changed and continued as before. She mentioned environmental concerns that included a lot <br />of dust in the area of the City that she represented. She would support revocation. <br />Member Raposo stated that when he drove by the site the day before this hearing, "it was a <br />mess." There was dust coming from Galbraith Golf Course and trucks were being loaded with <br />very dry dirt. He saw no gate, as the Applicant mentioned, to close the site off. He agreed with <br />the above comments made by his fellow Board Members. <br />Member Grazzini felt torn. He applauded the Applicant's commitment to the community and <br />his environmental concerns. However, nothing was said by the Applicant that addressed the <br />reasons for the Board's review of the Use Permit. <br />Planner Pollart stated that she would not be in attendance at the August 1, 2002, meeting. <br />Member Sidari stated that, since he was one of the two Board Members who originally heard <br />this item in 1996, he would like to be in attendance at the meeting when this item was decided. <br />He would not attend the August 15`h meeting. <br />After some discussion concerning the continuance date, it was decided to continue to August 1, <br />2002. <br />
