This is an increase from what the traffic study determined was a <br />fair share allocation of 7.4%. <br />C. Since the Planning Commission meeting, the developer had <br />discussed with staff, and agreed to fully fund the remainder with <br />future reimbursement. <br />d. The developer is obligated to procure the design plans for <br />intersection improvements for submittal to the City and CalTrans <br />to review. The start of the preliminary design and the aerial <br />photographs were distributed to the Commissioners. Discussions <br />with CalTrans staff had begin regarding the design work for the <br />intersection. <br />e. The design plans for the transportation improvements will be tied <br />to the first Certificate of Occupancy for the developer. <br />f. The developer will coordinate the project with the Westgate <br />Parkway Project. <br />5. Eden Road <br />a. The developer is obligated to pay for 4% of the project cost. <br />b. The future 4% obligation will be recorded as a covenant on all <br />parcels. <br />C. The City proposed the creation of the assessment district or other <br />financing method to collect the remaining cost of the project, so it <br />will be implemented in the time that it will be needed. <br />6. Davis Street Corridor Signal Timing Plan <br />a. There had been considerable discussion about the impact of the <br />core of the traffic beyond Davis and Doolittle, as well as the whole <br />corridor to 880. Staff had discussed this issue with the developer <br />with respect to the obligation under the traffic mitigation measures <br />for the Negative Declaration. The developer agreed to pay for the <br />full cost of the signing, improvements, and the signal phasing <br />along the corridor, and to implement these improvements. <br />Discussions had been initiated with CalTrans regarding how those <br />improvements may occur. <br />b. The traffic consultant indicated that a phased improvement could <br />improve traffic flow at this corridor by 16% regarding the traffic <br />flow and signal wait time. <br />C. The implementation is also tied to the development of the project, <br />and will be tied to the first Certificate of Occupancy. <br />7. Additional Transportation/Air Quality Conditions <br />a. The PD land use restrictions promote environmentally friendly <br />uses. <br />b. Promotion of clean air vehicles and equipment for uses on the site. <br />This was a suggestion from the neighbors' feedback. <br />
