Zeitz (property owner); IG Industrial General Zoning <br />District. [Debbie Pollart, Planner III] <br />Director Hom stated that this item was continued from the last Board of Zoning <br />Adjustments Special Meeting on July 18, 2002, and the public hearing was closed at that <br />meeting. He noted that the resolutions and findings to support the revocation of the <br />existing Use Permit were before the Board as an attached resolution. <br />Chair Marr asked if discussion should be heard before the vote. <br />Director Hom stated that discussion was appropriate, if the Board so wished. <br />A member of the public, Lou Filipovich, questioned the closing of the public hearing at <br />the last meeting. <br />Chair Marr explained the procedure. <br />Assistant City Attorney Goldfien stated that the speaker was out of order. <br />Member Eliason corrected the resolution to read, beginning, "Now, therefore, the <br />Ceuneil the Board of Zoning Adjustments of the City of San Leandro does resolve as <br />follows:" <br />A member of the public wished to make a point of order. <br />Assistant City Attorney Goldfien stated that only a Member of the Board could make a <br />point of order. <br />Chair Marr reminded the public that the public hearing was closed. <br />Assistant City Attorney Goldfien stated that if the Board wished to open the public <br />hearing, it could do so, but it was not required to do so. <br />Chair Marr reminded the attendees that public hearing would be allowed for the other <br />items on the agenda. <br />Motion to revoke the Conditional Use Permit and approve the <br />Resolution for the Revocation of CU-93-14, <br />C & G Contractors, Inc. <br />(Eliason/Sidari; 6 Ayes; 0 Noes; Abstain — Shields) <br />
