CITY OF SAN LEANDRO <br />D ATE: July 24, 1996 <br />TO: Board of Zoning Adjustments <br />FROM: Steve Emslie, Planning Manager <br />BY: Joann Oliver, Community Standards Coordinator <br />SUBJECT: Hearing to Modify or Revoke the Conditional Use Permit CU-93-14 for C & G <br />Contractors, Inc., 2660 Eden Road <br />Summary and Recommendation <br />G Contractors, operated by Mr. Jerry Guss, and located at 2660 Eden Road, has a Conditional <br />Permit (CU-93-14) to collect, store, process and distribute concrete, asphalt and dirt. In <br />response to market changes, the activity has changed since the permit was issued. Staff has been <br />working with C & G Contractors since early 1995 to resolve violations and bring the activity into <br />compliance with the Permit and City regulations. In summary, the violations include storage of <br />material in excess of the permitted volumes, grading and erosion control violations. <br />The purpose of this hearing is to modify or revoke the Conditional Use Permit for failure to comply <br />with the terms of the Permit and violations of the Grading Ordinance. Staff is recommending <br />modifications to the Conditional Use Permit and deadlines for bringing the site into compliance. <br />Our objectit,e is to correct" the violations, protect adjacent properties,. provide flexibility for the <br />operation and allow the business to successfully operate on the site. <br />BACKGROUND <br />In early 1995, it came to the City's attention that the activity at C & G Contractors appeared to <br />exceed the limitations established in the Conditional Use Permit. The Use Permit authorized the <br />recycling of concrete and asphalt through the processing of the material into two foot by two foot <br />size pieces for removal for further processing to another location outside of San Leandro.
