fill dirt and a shipping area. The plan shows piles which are 15 feet high and 40 feet in diameter. <br />Access around each pile, as well as access to all parking and the building, is identified. <br />_nspections of the site revealed that the activity on the site did not conform with the approved <br />permit. Due to changes in demand, Mr. Guss began to stockpile dirt. Inspections revealed one <br />large pile of dirt approximately 20 feet high and covering most of the lot. The pile of dirt went up <br />to the fences on the east, north and west property lines. Emergency access was not provided. <br />On February 21, 1995, staff contacted Mr. Guss on the site. During that conversation, Mr. Guss <br />was required to stop bringing dirt to the site and to apply for a modification to the Conditional Use <br />Permit, if he planned to continue the activity in this manner. Follow-up inspections revealed no <br />substantial change in the activity. <br />On June 26, 1995 a Notice of Violation was issued to Mr. Guss requiring that he cease all activity <br />on the site, submit an action plan to bring the site into compliance and secure required grading <br />permits. <br />Mr. Guss did not submit the action plan as required and the condition of the site did not change <br />substantially. On July 26, 1995, staff met with Mr. Guss. He indicated at that time that he was not <br />accepting more dirt Mr. Guss submitted receipts demonstrating that dirt was being removed from <br />the site. <br />During a follow-up inspection conducted on November 2, 1995, staff found that there was a large <br />ile of dirt on Eden Road. Two loaders were working on the pile of dirt. The pile completely <br />:)structed the emergency access to the Water Pollution Control Plant. In addition, the volume of <br />dirt on the property continued to exceed what had been approved in the pern-it. <br />In response to the continued violations, a hearing was held on November 15, 1995 before the <br />Zoning Enforcement Official, Steve Emslie, for the purpose of determining compliance with the <br />Conditional Use Permit. In the hearing, staff and Mr. Guss agreed to several conditions to bring the <br />site into compliance. <br />On Januan• 26, 1996, Andrew Gaber, Senior Engineer, issued a Notice of Pending Citation for <br />failure to comply with the Use Permit and for placing material onto Eden Road and the Galbraith <br />Golf Course service yard in violation of the City_'_'-s Grading Ordinance. Inspections revealed that <br />the westerly 250 feet of Eden Road had been raised an average of 2.5 feet, and that additional <br />material had been added to the stock pile on the site. Mr. Guss was required to submit a Grading <br />Permit Application and a Grading and Erosion Control Plan, and remove the fill placed on Eden <br />Road and the golf course site.
