Padro: It appears that many effor at very regard were entertained by rties, beginning
in February, 1995 up to Novembei, _ _ _ and beyond. That is why I asked , estion. I
certainly see that provision that is summarizing staff s report-1 was hoping to hear. something
:rent than that.
unver: We are attempting to give Mr. Guss a last opportunity to bring the site into compliance.
That is the basis for our recommendation.
Eliason: I noticed in here you mentioned something about placing material in the golf course
service yard. Could you explain about that?
Oliver: Perhaps I can show on the overhead. The golf course service yard is directly across the
street from C&G Contractors, Inc. It is the Galbraith Golf Course's service yard. Material was
placed on Eden Road, again to level out Eden Road, and up on the service yard in an attempt to
provide a turn -around so you could turn around on Eden Road and swing back. It is a lot easier
to turn around out there now. I believe that was done with the property owner's permission. Mr.
Guss knows the owners of Galbraith Golf Course. It is my understanding it was with their
permission.
Eliason: But it was without a grading permit.
Oliver: Correct.
Eliason: If we revoked this permit tonight, how would we get the property cleaned up?
iver: It will be up to the property owner, ultimately, to insure that the property is cleaned up.
,,,at is why the Engineering Department has put the requirement in for placing the performance
and maintenance bonds so that if, in fact, the property was not cleaned up and the property owner
did not clean it up, there would be funds available to do that. Although, frankly, I think ?.redrew
Gaber can answer this better, I believe our first priority would be to make any corrections
necessary on Eden Road before we took steps to clean up the private property.
Eliason: Lastly, you have the condition regarding the performance bond. Now Mr. Guss has
said that he was unable to secure a performance bond. If he is unable to secure one, why are we
requiring one if one can't be obtained.
Oliver: There are a number of ways that the performance bond can be secured. I think Andrew
Gaber may be better able to answer that.
Gaber: Good evening. It is written as a performance deposit because we will accept cash,
checks. traveler's' checks, VISA, Mastercard; letters of credit have worked before.. We have
worked with developers who had partial cash, partial letter of credit, a bond. We see Eden Road
as a relatively short term commitment. It should not take that long to do the work so we would
not be holding the bond for very long. We will work with whatever he can provide.
' IcGallian: Are there any other questions of staff?
Board of Zoning Adjustments MeetAugust 1, 1996
Meeting
Minute No. 96-15 J
;U .
