,,AN LEANDRO <br />BOARD OF ZONING ADJUSTMENTS <br />San Leandro Community Library Center <br />300 Estudillo Avenue <br />San Leandro, CA 94577 <br />MINUTE NO. 96-15 August 1,1996 <br />The regular meeting of the Board of Zoning Adjustments was called to order at 7:30 p.m. in the <br />Lecture Hall at 300 Estudillo Avenue, San Leandro, California. <br />ROLL CALL: Present: Members Eliason, Shields, Vice Chairperson Padro and Chairperson <br />McGallian <br />Absent: Members Badger and Sidari <br />Staff: Rick Jarvis, City Attorney; Joann Oliver, Community Standards <br />Coordinator; Andrew Gaber, Senior Engineer; Recording <br />Secretary Linda Adams and Secretary Norm Weisbrod. <br />MINUTES: Minutes of the July 18, 1996 were approved as submitted. <br />(Eliason/Padro; 3 ayes; Shields abstained) <br />MRRESPONDENCE: None. <br />BLIC COMMENTS: None. <br />PUBLIC HEARING: <br />Item: CU-93-14; Conditional Use Permit; to modify or revoke Conditional Use Permit for the <br />collection, storage , processing and distribution of concrete, asphalt and dirt at 2660 Eden Road; <br />Assessor's Parcel Number 42-4530-4; C&G Contractors, Inc. <br />Oliver: Presented staff report recommending the Board approve modifications to the <br />Conditional Use Permit and establish a deadline of October 15, 1996 for bringing the site into <br />compliance, at which time, if the site is not in full compliance with the Conditional Use Permit, <br />the permit Mll be revoked and the business owner will immediately cease all activity on the site. <br />Upon revocation, the business owner will remove all material from the site within one month of <br />revocation. <br />Padro: With the process between Mr. Guss and City staff, beginning in February; 1995, were <br />we to modify- the Conditional Use Permit, how will we be assured that compliance with those <br />modifications would be met? <br />()liver: That is precisely why we included the final recommendation that failure to comply, in <br />.at we consider a reasonable but limited deadline of October 15, will result in the revocation of <br />permit. So, this is a last opportunity to get everything under control and get the site into <br />conformance, come up with a permit that Mr. Guss can live with. If that doesn't work, we are <br />recommending that the permit be revoked at that point. <br />a ;� <br />
