2660 Eden Road Appea 5 October 7, 2002
Revocation of CU-93-14
Permits and/or Variances Granted
CU-93-14, originally granted in 1993 by the Board of Zoning Adjustments, was
subject to conditions of approval (which were modified in 1996). That use permit
was revoked by the Board of Zoning Adjustments in 1996, and more recently
again in 2002. The findings for revocation include violation of the terms and
conditions of the use permit.
Specifically, the operator has consistently maintained piles of material in excess
of the 15-foot height limitation contained in the CUP; required clearances for
emergency vehicles have not been properly maintained; and encroachments and
damage to City -owned property adjacent to the operator have occurred.
Environmental Review
This matter is categorically exempt from the California Environmental Quality
Act (CEQA) per CEQA Guidelines, Article 19, Section 15321.
Code Compliance Review
Not applicable
Board/Commission Findings
At its meeting of July 18, 2002, the Board of Zoning Adjustments directed staff
and the City Attorney's Office to return with a Resolution for revocation of the
use permit. At its meeting of August 1, 2002, the Board of Zoning Adjustments
voted 6-0 (with one abstention) to revoke CU-93-14.
Summary of Public Outreach Efforts
For the July 18, 2002 Board of Zoning Adjustments public hearing, normal
noticing, including a legal ad, posting of the property, and notification for the
300-foot radius was performed. As the item was continued to a date specific for
the August 1, 2002 meeting, no other notification was legally required. At the July
18, 2002 public hearing, the business operator spoke in opposition to having his
use permit revoked. One other member of the public spoke, indicating that he felt
the City had done all it could to bring the business into compliance, and that the
City's efforts had been ignored.
Fiscal Impact
Not applicable
Budget Authority
Not applicable
