2660 Eden Road Appea 5 October 7, 2002 <br />Revocation of CU-93-14 <br />Permits and/or Variances Granted <br />CU-93-14, originally granted in 1993 by the Board of Zoning Adjustments, was <br />subject to conditions of approval (which were modified in 1996). That use permit <br />was revoked by the Board of Zoning Adjustments in 1996, and more recently <br />again in 2002. The findings for revocation include violation of the terms and <br />conditions of the use permit. <br />Specifically, the operator has consistently maintained piles of material in excess <br />of the 15-foot height limitation contained in the CUP; required clearances for <br />emergency vehicles have not been properly maintained; and encroachments and <br />damage to City -owned property adjacent to the operator have occurred. <br />Environmental Review <br />This matter is categorically exempt from the California Environmental Quality <br />Act (CEQA) per CEQA Guidelines, Article 19, Section 15321. <br />Code Compliance Review <br />Not applicable <br />Board/Commission Findings <br />At its meeting of July 18, 2002, the Board of Zoning Adjustments directed staff <br />and the City Attorney's Office to return with a Resolution for revocation of the <br />use permit. At its meeting of August 1, 2002, the Board of Zoning Adjustments <br />voted 6-0 (with one abstention) to revoke CU-93-14. <br />Summary of Public Outreach Efforts <br />For the July 18, 2002 Board of Zoning Adjustments public hearing, normal <br />noticing, including a legal ad, posting of the property, and notification for the <br />300-foot radius was performed. As the item was continued to a date specific for <br />the August 1, 2002 meeting, no other notification was legally required. At the July <br />18, 2002 public hearing, the business operator spoke in opposition to having his <br />use permit revoked. One other member of the public spoke, indicating that he felt <br />the City had done all it could to bring the business into compliance, and that the <br />City's efforts had been ignored. <br />Fiscal Impact <br />Not applicable <br />Budget Authority <br />Not applicable <br />
