Board of Zoning Adjustments Staff Report and Resolution dated August 1, <br />2002 <br />CONCLUSION <br />In the interim since the Board of Zoning Adjustments' decision to revoke the use permit, <br />the appellant appears to have brought the business into substantial compliance by limiting <br />the height of the stockpile to less than 15 feet and maintaining required clearances for <br />emergency personnel. Although the appellant's business operation was the cause for <br />damage to the WPCP's fence, he did provide some initial assistance in getting a new <br />fence installed by removing stockpiled materials along this property line. In providing an <br />option for the City Council to continue the matter of the revocation/appeal for a period of <br />three months, staff will monitor the site and report back to the City Council as to whether <br />the business remains in substantial conformance. During this time, staff will also work on <br />reaching an agreement with the appellant for reimbursement of City funds spent on the <br />new fence.
