IN THE BOARD OF ZONING ADJUSTMENTS FOR THE CITY OF SAN LEANDRO <br />RESOLUTION NO.2002- <br />A RESOLUTION REVOKING CONDITIONAL USE PERMIT CU-93-14 FOR THE <br />COLLECTION, STORAGE, PROCESSING AND DISTRIBUTION OF CONCRETE, <br />ASPHALT AND DIRT, ISSUED TO C&G CONTRACTORS FOR 2660 EDEN ROAD, SAN <br />LEANDRO (ASSESSORS PARCEL 42-4530-4) <br />RECITALS <br />WHEREAS, on October 7, 1993 a Conditional Use Permit CU-93-14, was approved by <br />the Board of Zoning Adjustments of the City of San Leandro (hereafter `Board") for C&G <br />Contractors ("C&G") permitting the collection, storage, processing and distribution of concrete, <br />asphalt, and dirt, at the property known as 2660 Eden Road, San Leandro (Assessors Parcel 42- <br />4530-4) (hereafter "CUP'D; and <br />WHEREAS, on October 21, 1996, the City Council of the City of San Leandro found that <br />C&G was in violation of the CUP, and granted a six-month extension of the permit to allow <br />C&G to bring its operation into compliance with the terms of its CUP and in conformance with <br />Chapter 7-12 of the Municipal Code, the City's Grading, Excavation, and Fills ordinance; and <br />WHEREAS, on October 5, 2001, C&G was notified by City staff that it was again in <br />violation of its use permit, and what actions would be required to attain compliance; <br />WHEREAS, C&G has not complied with the actions specified in staff s letter of October <br />5, 2001, and the Zoning Enforcement Official of the City of San Leandro has determined that <br />reasonable grounds exist for revocation of the CUP; and <br />WHEREAS, the Zoning Enforcement Official set a public hearing before the Board to <br />consider whether the CUP should be revoked; and <br />WHEREAS, said public hearing was duly noticed in the same manner required for public <br />hearings to approve conditional use permit applications; and <br />WHEREAS, the Board conducted said public hearing, and received written, photographic <br />and oral testimony from representatives of the permit holder, C&G Contractors, from City staff, <br />and from the public; and <br />WHEREAS, the Board continued the public hearing to its next regular meeting, for <br />consideration of a resolution revoking the CUP; and <br />WHEREAS, the Board has fully considered the arguments made by and on behalf of <br />C&G, and all other testimony and evidence presented at the public hearing. <br />
