No State Laws <br />There are no California State laws, regulations or rules on how to <br />conduct preferential elections. Until there are such laws the Registrar of <br />Voters is unable to conduct this type of election. <br />California law does not require cities to consolidate their elections with <br />primary or general elections. In addition, cities are not required to use the <br />services of the County Registrar to conduct municipal elections. If a city <br />wishes to conduct elections utilizing an election process that is not covered <br />by State law the Alameda County Registrar of Voters office will have to <br />decline to be involved in the election. There are several charter cities in <br />Alameda County, each with the authority to establish their own charter <br />provisions and codes related to the conduct of municipal elections. It is not <br />possible for this office to conduct elections under several different sets of <br />municipal codes. <br />The experiences of the 2000 presidential election demonstrated how <br />complex and difficult it is to conduct an election properly. Until such time <br />as State election law is amended to regulate the conduct of preferential <br />elections, the Alameda County Registrar of Voters will have to respectfully <br />decline to be involved in municipal elections conducted this way and allow <br />the City to administer and conduct its own elections. <br />Sincerely, <br />adley J.
