,_9 Driveway Policy Statement 3
January 26, 2001
statement (attached) regarding substandard driveways in residential street
reconstruction areas has been developed for the full City Council consideration.
The policy stipulates that the City shall be responsible for half the cost of
construction of a replacement standard City driveway when the property owner
opts to replace the existing substandard driveway as a result of City financed
residential street reconstruction. The City Engineer is required to determine
eligibility. It further stipulates that the City shall provide proper notice of the
reconstruction's potential impact on the access to the property prior to the street
reconstruction work. At the time that the notice is given, the property owner is
presented with an opportunity to opt for a replacement driveway, if the City
Engineer has determined that the property owner's driveway is substandard.
All property owners in the newly reconstruction streets, in accordance with the
new policy, are not allowed to use appurtenances of any sort to ameliorate any
grade differences between their driveways and the newly reconstructed street.
Current City Council Policy
• Property owner pays for full cost of driveway replacement
Previous City Council Action(s)
None
City Council Committee Review and Action
• Action is recommended by the Council Adhoc Committee
Applicable General Plan Policy
Not Applicable
Permits and/or Variances Granted
Not Applicable
Environmental Review
None required for this action
Code Compliance Review
Not Applicable
S5
