Jermanis C�aolo <br />Ex five Director <br />Luke Sims, Economic Development Manager 0 <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />Motion Approving a Policy Statement Regarding the Joint City of San Leandro -County <br />of Alameda Redevelopment Project and the Use of Eminent Domain for the Marina <br />Square Auto Center. <br />SUMMARY AND RECOMMENDATION <br />On February 5, 2001, the City Council and Redevelopment Agency approved a joint <br />Resolution recognizing the historic contributions and value of the Yokota Rose Nursery <br />on Marina Boulevard and declaring that neither the City nor the Agency would use <br />eminent domain to acquire the property. As part of that approval, the Council directed <br />staff to prepare a Policy Statement regarding the use of eminent domain in furtherance of <br />the Auto Center along Marina Boulevard. <br />The attached Policy Statement provides that: 1) no further property be acquired by the <br />use of the power of eminent domain for auto mall purposes; 2) the S-Overlay zoning <br />district remain the primary land use tool governing this portion of the Joint Project Area; <br />and 3) the Agency's participation in the auto mall will be limited to financial assistance as <br />necessary to make new dealerships financially feasible. <br />It is recommended that the Redevelopment Agency approve the Policy Statement. <br />BACKGROUND <br />Current City Council/Redevelopment Agency Policy <br />The City of San Leandro -County of Alameda (Joint) Redevelopment Plan provides for <br />the power of eminent domain for most of the properties along Marina Boulevard. In the <br />past, the Redevelopment Agency has adopted Resolutions of Necessity declaring the <br />intent to acquire specific property through the use of eminent domain. These Resolutions <br />have been adopted solely for vacant or unused properties. While the use of eminent <br />domain authority has been limited to vacant or unused properties, the Agency has not <br />123 <br />
