Appeal of PLN2001-00005 Denial 5 05/14/01
Summary of Public Outreach Efforts
• The mailing notification for this public hearing was the standard 300-foot radius.
Fiscal Impact
Not applicable.
Budget Authority
Not applicable.
Attachments:
• Vicinity Map
• Board of Zoning Adjustments Staff Report, dated April 5, 2001
• Adopted Findings for Denial
• Draft Findings for Approval
• Recommended Conditions of Approval
• Exhibit A — Site Plan of Primary Site, adjacent to 527 Harlan Street
• Exhibit B — Site Plan of Secondary Site, adjacent to 520 Harlan Street and 597 Castro Street
• Aerial Photograph
• City's Bikeway Plan Table 7 Proposed Bike System
• City's Bikeway Plan Figure 12 Proposed Bike System
• CU-00-6 Agreement to Conditions
• Applicant's Lease Agreement with Union Pacific Railroad
• Letter from Camozzi Carpet Corporation, dated April 2, 2001
• Excerpts from the Board of Zoning Adjustments Meeting of April 5, 2001
CONCLUSION
Upholding the Board's denial of the application would prevent the precedent of allowing outdoor
vehicle or equipment storage in the railroad right-of-ways. In addition, outdoor storage yards in
the railroad properties has the potential to have a detrimental and negative impact to City's efforts
and investments to enhance City corridors, thoroughfares, and special focus areas such as the San
Leandro Boulevard. The proposed expansion would also conflict with the City's Bikeway Plan
where a bikepath is proposed along the Union Pacific right-of-way.
If the City Council feels it can make the findings to approve the application, staff recommends
that the Council overturn the Board's denial and approve, by motion, the vehicle storage on the
contiguous lot only, subject to the attached Recommended Findings and Conditions of Approval.
G:\elmer\PLN2001-00005 bills tow\PLN2001-00005, 5-21-2001 CC SR
5
