Appeal of PLN2001-00005 Denial 4 05/14/01 <br />Applicable General Plan Policy <br />The proposed vehicle and equipment storage in the railroad right-of-way and the precedent it <br />- - would set if approved could be in conflict with the following policies in the City's General Plan <br />relating to land use: <br />1. New development shall be compatible with adjacent existing development. (page V-97). <br />2. The City will actively seek to enhance the image and definition of San Leandro by upgrading <br />the appearance and quality of all major entry streets. (page V-98). <br />3. The City's Bikeway Plan specifies a proposed bicycle corridor identified as the BART Line <br />Trail to provide a north -south connection through the City, between Oakland and San <br />Lorenzo. As a bicycle corridor it will serve BART stations directly, divert bicycles from busy <br />arterial streets, and has the potential to become a regional route (City's Bikeway Plan Figure <br />12 and Table 7). <br />Permits and/or Variances Granted <br />• Last May 2000, the Board of Zoning Adjustments approved a conditional use permit to allow <br />indoor and outdoor vehicle storage for impounded vehicles, for Bill's Towing at 527 Harlan <br />Street. The site was already developed with a warehouse building and offices, and an outdoor <br />storage yard at the rear of the property. <br />• Pursuant to Zoning Code Section 2-712 AA., a conditional use permit is required for vehicle <br />storage in the IL Industrial Limited District. A modification of the existing use permit is <br />required for expansion of the use as proposed. <br />Environmental Review <br />This item has been reviewed in accordance with the California Environmental Quality Act <br />(CEQA) and has been determined to be categorically exempt within the provisions of CEQA <br />Guidelines, Article 19, Section 15311, Accessory Structures. <br />Code Compliance Review <br />Not applicable. <br />Board/Commission Findings <br />• The Board of Zoning Adjustments reviewed this application at its meeting on April 5, 2001. The <br />Board made the necessary findings to deny and denied the conditional use application. Those <br />findings are attached to this report. <br />a <br />
