Zoning Work Session 3 <br />June 11, 2001 <br />be the Zoning Enforcement Official) takes action. For larger projects, which include <br />applications for exceptions as described, notice of a hearing by the Board of Zoning <br />Adjustments will be given to neighboring owners within 500 feet of the project site. <br />"City -Wide" (other than RS-VP Sub -district) - Regulation of Large Homes." A special <br />review process is proposed for any home that is: <br />■ over 4,000 sq. ft in size, or <br />■ more than double the size of an existing home, or <br />■ a new two-story home, or a second story addition, or <br />■ any third story addition <br />Any of the above single-family projects would require the notification of surrounding <br />neighbors of the proposal. Neighbors would be able to comment at a hearing on potential <br />impacts, regarding concerns such as a loss of privacy or view. The decision -maker <br />(proposed to be the Zoning Enforcement Official) would be required to make findings that <br />the proposal "fits in" with the existing neighborhood for the project to approved. Decisions <br />of the Zoning Enforcement Official would be appealed to the Board of Zoning Adjustments. <br />II. Proposed Changes to City's Review Authority Over Group (Congregate) Homes <br />➢ "Residential Congreizate Care Facilities." Definitions and use regulations have been revised <br />to reflect recent changes in State Law which prescribe the types and ways cities can regulate <br />group homes. While cities are generally prohibited from placing zoning restrictions on <br />"congregate care" facilities that serve six or less residents, cities may regulate larger <br />facilities to avoid "over concentration." A minimum 1000' spacing requirement has been <br />proposed for such facilities that serve over six residents. <br />➢ "Group Housing." Outside of the "protected classes" of care facilities the State has <br />established, cities have broad latitude to establish regulations. In most cases, "group <br />housing" that is not a protected class (e.g. senior citizen's "assisted living" housing <br />complexes) would only be permitted as a conditional use in the RM (Residential Multi- <br />family) District, requiring neighborhood notification and use permit approval. <br />III. Proposed Changes to City's Review Authority Over Some Commercial Uses <br />"Check-Cashing//Payroll Advance Loan Business." Permanent regulations are proposed to <br />replace the moratorium.
