Zoning Work Session 4 <br />June 11, 2001 <br />"Cigarette Stores." Permanent regulations are proposed to replace the moratorium. All <br />such business would require use permit approval, and, per the current Draft, would be <br />subject to a 1,500-foot spacing requirement from other such businesses, as well as from <br />schools, parks etc. <br />"Convenience Stores" To be more consistent with the proposed spacing requirement of <br />"Cigarette Stores" from schools, parks, etc, the spacing requirement of "Convenience <br />Stores" would be increased from 500 to 1000 feet. <br />"Liquor Beer and Wine Stores." To be more consistent with such similar uses as "Cigarette <br />Stores" and "Convenience Stores," a new spacing requirement from schools, parks, etc, of <br />1,000 feet is proposed (there is currently no spacing requirement for "Liquor Beer and <br />Wine" stores). <br />IV. Change to City's Review Authority Over Some Industrial Uses and Activities <br />➢ Some uses (e.g., newly constructed storage warehouses and auto repair facilities) that are <br />now "permitted" will become "discretionary," requiring use permit review and approval by <br />the Board of Zoning Adjustments before they can begin. In the initial Draft, a wider range <br />of industrial uses would have required use permit review. The Planning Commission, <br />upon input from industrial business and property owners and their agents, directed staff to <br />narrow the range of industrial uses that would require use permit review. <br />➢ A new use classification for "Parcel Processing and Shipping Facility" (e.g. hubs for such <br />companies as DHL Fed Ex etc.) is being proposed to better classify this growing type of <br />freight forwarding business. This use will generally be "permitted" without use permit <br />review, but administrative review, (i.e. review and approval by the Zoning Enforcement <br />Official), will be required for large, new facilities to review potential traffic and noise <br />impacts. <br />➢ A 200' "buffer" area is proposed for those industrial areas adjacent to Residential Zoning <br />Districts (other than areas separated from the Residential Districts by the 880 Freeway or a <br />railroad mainline, which are exempted from the "buffer" requirements). The buffer <br />regulations as currently proposed are: <br />• To be implemented administratively (no use permit with public hearing will be <br />required) <br />• Mitigation for noise impacts will be regulated with a ministerial requirement for <br />physical improvements at the time building permits for new truck bays are issued (e.g. <br />rubber truck dock bumpers and installation of signage to encourage a reduction of <br />extraneous noise — "be a good neighbor"). <br />16 \\1)WYS\USM\1)EPMS\CoreyQDnmg - staff reports\CC 2001-7-20- Worksession staff report 6-1 Ldoc <br />
