IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO.2001- <br />A RESOLUTION AMENDING TITLE 6, CHAPTER 7 <br />OF THE SAN LEANDRO ADMINSTRATIVE CODE <br />RELATING TO THE CITY'S REAL PROPERTY TRANSFER TAX <br />AND ADDING REGULATIONS GOVERNING REBATES <br />WHEREAS, the City Council has adopted Ordinance number 2001- <br />amending Title 2, Chapter 2-3 of the San Leandro Municipal Code relating to the City's <br />Real Property Transfer Tax; and <br />WHEREAS, such amendment requires corresponding amendments and changes <br />to the San Leandro Administrative Code. <br />NOW, THEREFORE, the City Council of the City of San Leandro does <br />RESOLVE as follows: <br />1. Chapter 7 of Title 6 of the San Leandro Administrative Code is here by <br />amended by adding the following sections: <br />46 7 130 Rebates Qualifying Seismic Retrofitting Work. <br />a. Applicants for a rebate pursuant to Section 2-3-112 of the Municipal Code shall <br />submit an application for a rebate on the form approved by the Finance Department for <br />that purpose, within the time period provided in that section. <br />b. "Qualifying Seismic Retrofitting Work," as that term is used in Section 2-3- <br />112, means any of the following: <br />1. Work which either structurally strengthens or provides the means necessary to <br />resist seismic force levels that would otherwise be experienced by an existing building or <br />structure during an earthquake, so as to significantly reduce hazards to life and safety <br />while also providing for safe ingress and egress of building occupants during and <br />immediately after an earthquake; or <br />2. Seismic retrofitting" includes, but is not limited to, those items referenced in <br />Appendix Chapter 6 the 1997 Uniform Code for Building Conservation and "The <br />Guidelines for the Seismic Retrofit of Existing Buildings", Chapter 3, of the International <br />Conference of Building Officials; installation of shear walls; anchoring of water heaters; <br />and/or securing of chimneys, stacks or water heaters; or <br />3. Any other work found by the Chief Building Official to substantially increase <br />the capability of the structure to withstand damage or destruction in the event of an <br />earthquake. <br />
