Such exempt unit employees will be required to submit <br />to the Union a notarized letter certifying that <br />person's membership in such a religion, body or sect, <br />signed by an official of the bona fide religion, body <br />or sect. If an employee fails to authorize one of the <br />above deductions within the thirty (30) day <br />authorization period, the Union shall notify the <br />employee in writing of his/her contractual obligation <br />to authorize one of the payroll deductions. <br />If an employee fails to authorize one of the <br />deductions, the Union may seek enforcement through the <br />courts. <br />2. Service Fee Enforcement <br />The Union shall be responsible for enforcing the <br />provisions of this section using appropriate civil <br />procedures. The City is not responsible for <br />disciplining employees for violation of this section. <br />3. Forfeiture of Deductions <br />If the balance of an employee's wages, after all other <br />involuntary and insurance premium deductions are made <br />in any one pay period, is not sufficient to pay <br />deductions by this article, no such deductions shall <br />be made for that period. <br />4. Financial Documentation <br />a) The Union has presented a demonstration that the <br />legally permissible costs that may be charged as <br />a service fee to a non-member equals somewhat <br />more than ninety-five percent (95%) of dues. <br />The City has not challenged that demonstration <br />and agrees to deduct a service fee equal to <br />ninety-five percent (95%) of dues. <br />b) The Union shall, within ninety (90) days after <br />the end of each fiscal year, make available to <br />the City financial documentation, which shall <br />meet the requirements of Government Code section <br />3502.2. <br />c) The City agrees to provide the Union the name, <br />department, class, and payroll deduction status <br />of all unit employees on a monthly basis. <br />5.
