represents an election rescinding agency shop <br />and such petition contains signatures collected <br />within a forty-five (45) day period, of at least <br />thirty percent (30%) of the employees in the <br />bargaining unit, an election will be held. Such <br />election may be held only once during the term <br />of this Agreement. The verification of the <br />petition and the election shall be conducted by <br />State Conciliation Service. Voting shall be by <br />secret ballot, and a majority vote of all <br />employees in the bargaining unit shall be <br />required to rescind agency shop. <br />b) A unit employee who is subject to the payment of <br />a representation service fee hereunder has <br />certain legal rights to object to that part of <br />the fee payable by him or her which represents <br />the employee's additional prorata share of <br />expenditures by the Union that is utilized for <br />expenditures not incurred for the purpose of <br />performing the duties incident to effective <br />representation in employer -employee relations. <br />An employee wishing to exercise these rights <br />must contact the Union. <br />6. Hold Harmless <br />The Union agrees to indemnify and defend the City and <br />its officers, employees and agents against all claims, <br />proceeding and liability arising, directly or <br />indirectly, out of any actions taken or not taken by <br />or on behalf of the City under this Section. In <br />addition, the Union shall refund to the City of San <br />Leandro any amounts paid to or upon presentation of <br />supporting evidence. <br />Section 3. Advance Notice <br />Except in cases of emergency as provided in this section, <br />the City Council and boards and commissions designated by <br />law or by the City Council, shall give reasonable written <br />notice to the Union of any ordinance, rule, resolution or <br />regulation directly relating to matters within the scope of <br />representation, including matters subject to consultation, <br />proposed to be adopted by the City Council or such boards <br />and commissions and shall give such recognized Union the <br />opportunity to meet with the City Council or such boards <br />and commissions. The Union shall give reasonable written <br />notice to the Municipal Employee Relations Officer of any <br />matter within the scope of representation, including <br />matters subject to consultation, proposed to be <br />communicated to the City Council or such boards and <br />commissions. <br />4 <br />
