City Council Staff Report February 9, 1999 <br />General Plan Amendment; A-98-8; PD-98-2; TM 7078 Page 2 of 12 <br />The Planning Commission and staff recommend that the City Council take the following actions: <br />A. Adopt by motion the attached Mitigated Negative Declaration that provides mitigation <br />measures required for the project to avoid significant effects on the environment. <br />B. Amend the General Plan to include residential development as a potential use in the <br />Peralta Avenue Area, west of San Leandro Boulevard, by adopting the attached <br />Ordinance. <br />C. Approve the Rezoning (A-98-8) of the property from IG-S Industrial General Special <br />Study Overlay and IG Industrial General Districts to RS(PD) Residential, Single -Family, <br />Planned Development Overlay District by adopting the attached Ordinance. <br />D. Approve by motion the Redevelopment of the property with a new residential <br />neighborhood (Planned Development, PD-98-2), subject to recommended Conditions of <br />Approval. <br />E. Approve the Vesting Tentative Map, Tract 7078 subject to recommended Conditions of <br />Approval by adopting the attached Resolution. <br />BACKGROUND <br />The DeSilva Group, the applicant, proposes to redevelop the end of Peralta Avenue, west of the <br />BART right-of-way, (which includes, the former Cherry City Nursery, the Smooke Property, <br />Bergen Tires and Duarte Towing), with a new residential subdivision. This proposal is an <br />opportunity to create a new neighborhood within walking distance of the downtown and BART. <br />The property consists of a 44.6-acre area bounded by the BART right-of-way to the east, the San <br />Leandro Creek to the south, the Southern Pacific Railroad right-of-way to the west, and the San <br />Leandro -Oakland border to the north. The area is also known as the Peralta Area. The properties <br />have a history of industrial usage, including a cut -flower nursery, manufacturing, vehicle storage <br />and maintenance, nursery, warehouse storage and distribution uses. <br />The project site is also known to have inadequate infrastructure. For example, it lacks a water <br />supply for domestic use and fire fighting. The streets have no curb, gutter or sidewalk, which <br />contributes to poor drainage and resulting in a poor appearance during the winter months. The <br />water damage from lack of street infrastructure contributes to high maintenance on the street, <br />including the need for repairing potholes. The area is currently accessible from Peralta Avenue, <br />and the Smooke property is accessed from Russet Street in the City of Oakland. <br />At the last Planning Commission meeting the applicant presented revised plans that illustrated <br />the following: <br />The 45-foot-wide lots were replaced with 50-foot-wide parcels to strengthen the architectural <br />elevations of those homes and lessen the visual impact of the garage doors that face the <br />2 <br />
