Jerfn s City Manag Jacqui Diaz, Interim Assistant to the City Manager Kathy Ornelas, Community Relations Representativev Change of Control of Cable Television Services from TCI to AT&T; Postponement of Lease Extension for TCI Facility at 2850 Marina Boulevard SUMMARY AND RECOMMENDATION TCI Cablevision, Inc. is requesting consent for change of control of cable television services in San Leandro from TCI to AT&T following the merger of these two companies. They have also notified the City that they wish to exercise an extension of their lease of City property at 2850 Marina Boulevard. After further staff research and review by a Sub Committee of the City Council Rules and Communications Committee, staff s recommendation will be to approve the merger, and thereby change of control, of TCI and AT&T, and to postpone approval of the lease extension due to existing multiple code and lease violations at the TCI facility on Marina Boulevard. A resolution will be placed on the January 4, 1999 City Council agenda for the City Council's consideration of the merger approval only. DISCUSSION These matters were discussed by the City Council during the December 7, 1998 City Council meeting. The Council expressed reservations regarding the merger of the two companies and felt there may be an opportunity for the City and the community of San Leandro to negotiate these matters in the interest of better public and City access to services provided by TCI. Concerns regarding operations at the Marina Boulevard site, including disturbances to neighboring residences caused by activity at the TCI facility, had been brought to the City's attention by a local property owner. A Sub Committee of the City Council Rules and Communications Committee was requested to review these matters further. 107
