PD-98-2 & Vesting Tentative Map Tract No.7078 Page 20 of 22 <br />Recommended Conditions of Approval February 9, 1999 <br />designate five (5) units as affordable to very low-income households to <br />fulfill the housing replacement requirement in Health and Safety Code <br />Section 33413(a). Moderate income households are households whose <br />income is one hundred twenty percent (120%) or less of area median gross <br />income as adjusted by household size; low income households are <br />households whose income is eighty percent (80%) or less of area median <br />gross income as adjusted by household size; and very low income <br />households are households whose income is fifty (50%) or less of area <br />median gross income as adjusted by household size. Area median gross <br />income is defined annually by the United States Department of Housing <br />and Urban Development. Affordable housing costs shall be the cost <br />defined in the Health and Safety Code section 50052.5. This requirement <br />shall be known as the Inclusionary Condition. <br />Developer acknowledges that the City and Redevelopment Agency desires <br />the affordable units to be spread throughout the Project. The Developer <br />shall designate the number of affordable units pursuant to the percentages <br />required in the Affordability Covenant for every group of sixty (60) homes <br />constructed. Developer may request modification of the 60 home <br />requirement from the Redevelopment Agency. <br />The number of affordable units required in the Inclusionary Condition <br />shall remain available at affordable cost as defined in the Condition until <br />2038, the period of the land use controls established in the Redevelopment <br />Plan for the Joint County of Alameda -City of San Leandro Redevelopment <br />Project Area adopted by San Leandro City Council Ordinance 93-012. <br />The Inclusionary Condition shall run with the land until the expiration of <br />the Condition in 2038. Express provisions setting forth the Inclusionary <br />Condition shall be included in all deeds of sale of each of the parcels <br />subject to the Inclusionary Condition for the duration of the Condition. <br />Developer shall cause the Inclusionary Condition to be recorded in the <br />office of the County of Alameda Recorder for each parcel to the Condition <br />at the time the Final Map is recorded. The document to be recorded by the <br />Developer, and the language to be included in the deeds, shall be approved <br />by the Redevelopment Administrator of the City of San Leandro <br />Redevelopment Agency prior to recordation. <br />Developer shall submit a marketing plan to the Redevelopment <br />Administrator at the time the Final Map is recorded that shall set forth the <br />developer's plans to market the inclusionary units. The marketing plan <br />shall be approved by the Redevelopment Administrator. <br />
