Extend Eminent Domain 2 September 12, 2000 <br />�-' Previous City Council Action(s) <br />The City Council has previously amended the Alameda County/City of San Leandro Redevelopment <br />Plan three times to extend the power of eminent domain to a limited number of commercially and <br />industrially zoned properties within both the incorporated and unincorporated portions of the project <br />area. There are over 3,000 parcels in the project area and eminent domain authority exists on 151 <br />parcels. The fifth amendment to the Ordinance governing the Redevelopment Plan would extend that <br />authority to an additional 21 parcels. <br />On August 29, 2000 the Alameda County Board of Supervisors unanimously voted to authorize the <br />Redevelopment Agency to approve the extension of eminent domain authority to an additional 17 <br />parcels within the unincorporated portion of the project area, based on a recommendation of County <br />staff. <br />City Council Committee Review and Action <br />N/A <br />Applicable General Plan Policy <br />N/A <br />Permits and/or Variances Granted <br />N/A <br />Environmental Review <br />Under the California Environmental Quality Act (CEQA), adopting an ordinance amending the <br />Redevelopment Plan to extend the power of eminent domain is not defined as a "project" (State of <br />California, CEQA Guidelines Section 15378). Therefore, no environmental review is required. Any <br />specific development project subsequently undertaken by the Agency requiring the use of eminent <br />domain powers may be subject to environmental review. <br />Code Compliance Review <br />N/A <br />Board/Commission Findings <br />N/A <br />Summary of Public Outreach Efforts <br />As required by State law, a public notice was mailed to all property owners, business owners and <br />residents within the Joint Project Area on August 17, 30 days prior to the public hearing. The notice <br />informed the business and property owners of the public hearing and provided a list of the affected <br />properties. Those receiving the letter were invited to contact either City or County staff to answer <br />any questions or respond to any concerns. Staff met with business and property owners as requested. <br />In addition, on August 16, the County's Citizens Advisory Committee met to consider a <br />recommendation in support of the extension of eminent domain authority to the seventeen additional <br />711 <br />
