City Council Staff Report July 12, 1999 <br />A-99-2 & PD-99-2 Page 8 of 10 <br />• Add a condition stating that any significant changes to the building or site plan shall be <br />referred back to the Planning Commission for review as determined by the Development <br />Services Director; <br />• Revise a condition so that left turns out onto Lewelling Boulevard will not be allowed unless <br />a plan for modification of the Lewelling Boulevard/Embers Way intersection and traffic <br />signal can be found satisfactory, etc. And also require that if left turns out onto Lewelling <br />Boulevard are allowed, then hours of operation shall be restricted during the hours between 7 <br />and 9 a.m. and 3 and 7 p.m. on weekdays, or as otherwise required by the Transportation <br />Administrator; <br />• Add a condition requiring that any significant changes to the proposed traffic access plan be <br />reviewed by the Planning Commission; <br />• Expand a condition to search for alternative filtration devices for storm water runoff, other <br />than mechanical type devices; <br />• Revise a conditions to require that the light fixtures be temporarily installed on the site and <br />reviewed at night by the adjacent residents prior to final installation; <br />• Under the traffic condition regarding left turns from Lewelling Boulevard, that the cost of <br />any intersection or traffic modifications that may be approved by the City be borne entirely <br />by the developer and not by the City or Redevelopment Agency; and <br />• Add a condition requiring a row of closely spaced columnar trees that shall be planted along <br />the west property line abutting the Victorian house to create a solid landscape screen. <br />ENVIRONMENTAL REVIEW <br />This project has been reviewed pursuant to the California Environmental Quality Act. The Initial <br />Study concluded that with the required mitigation measures, the rezoning and the Planned <br />Development would not have a significant impact on the environment. A Mitigated Negative <br />Declaration has been prepared. The required 30-day review period was between May 5, 1999 to <br />June 4, 1999. The City Council is the final legislative body to act on the rezoning and planned <br />development and, therefore, will act on the Mitigated Negative Declaration. <br />The noise impacts have been addressed and have been discussed in the Initial Study <br />accompanying the Mitigated Negative Declaration. The study includes recommendations in <br />reducing noise exposures in the indoor areas to 40 dBA. <br />As for other highlights in the Mitigated Negative Declaration, grading and drainage plans will be <br />monitored by the Engineering and Transportation Department. In addition, it found no <br />significant traffic impacts with the proposed restrictions of left -turns in and out from the <br />Lewelling Boulevard under the existing street configuration. <br />The neighbors expressed concern that the Mitigated Negative Declaration did not take into <br />consideration the visual impact the hotel would have on their views. Staff did explain that the <br />view will be changed, but the question from an environmental review perspective is whether the <br />hotel would be a significant impact. Staff s conclusion is that the measures taken by the <br />applicant to set the hotel building back with a separation of approximately 185- to 230-feet <br />between the exterior of the hotel and the adjacent homes, and the dense planting of fast growing <br />
