CU-99-4 Appeal - 4 - July 27, 1999 <br />The location of this cash advance/check cashing business is in accord with the objectives of <br />this Code and the purpose of the district, which is to provide sites for certain retail services <br />under specified limitations. The business will not include any physical change to the <br />existing shopping center, except the addition of a sign. The recommended conditions of <br />approval will protect the character of the area and maintain its consistency and <br />compatibility with the existing nearby development. Adequate off-street parking will be <br />retained on the property. <br />2. That the proposed location of the use and the proposed conditions under which it <br />would be operated or maintained will be consistent with the General Plan; will not be <br />detrimental to the public health, safety or welfare of persons residing or working in or <br />adjacent to the neighborhood of such use; and will not be detrimental to properties or <br />improvements in the vicinity or to the general welfare of the city. <br />The cash advance business will achieve the following General Plan Policies: <br />A. New development shall be compatible with adjacent existing development. <br />(V-97) <br />B. All land development, improvement and rehabilitation projects shall fully <br />provide for adequate parking, loading, access and on -site public facilities <br />and shall provide for improvement of on -site and off -site public facilities <br />without increasing the burden on existing public facilities or infrastructure. <br />(V-98) <br />This business is located in an area with compatible uses. The existing check cashing <br />business has not had detrimental impacts on the area. While the addition of another similar <br />business in the same shopping mall may be excessive, with the appropriate conditions of <br />approval the new cash advance business will not be detrimental or injurious to property and <br />will not be detrimental to the public health, safety, welfare or convenience. <br />3. That the proposed use will comply with the provisions of this Code, including any <br />specific condition required for the proposed use in the district in which it would be <br />located. <br />The check cashing business is a conditionally permitted use in the CC (PD) Community <br />Commercial District with a Planned Development overlay. The City Council, in <br />considering the conditional use application, will require specific conditions of approval to <br />ensure the proposed use will be compatible with the existing development in the area. <br />
