That the proposed use will not create adverse impacts on traffic or create demands <br />exceeding the capacity of public services and facilities which cannot be mitigated. <br />The existing site is adequately served by streets, utilities and other public facilities. <br />FINDINGS FOR DENIAL <br />In order for the City Council to deny the Conditional Use Permit, it must determine that at least one <br />of the above findings cannot be made. Given the direction of several of the BZA members at their <br />May 20'h meeting, staff recommends the following findings for denial should the City Council <br />decide to deny the use permit application: <br />1. That the proposed location of the use is not in accord with the objectives of this Code <br />and the purposes of the district in which the site is located. <br />According to the Zoning Code, commercial districts are intended to provide for a variety of <br />commercial uses while protecting these businesses from the adverse efforts of inharmonious <br />uses. This use is not in accord with the objectives of the Zoning Code because it will create <br />an over -concentration of a use that will be detrimental to surrounding businesses and the <br />neighborhood. <br />2. That the proposed location of the use and the proposed conditions under which it <br />would be operated or maintained will not be consistent with the General Plan; will be <br />detrimental to the public health, safety or welfare of persons residing or working in or <br />adjacent to the neighborhood of such use; and will be detrimental to properties or <br />improvements in the vicinity or to the general welfare of the city. <br />The payroll advance business will not achieve the following General Plan Policies: <br />A. New development shall be compatible with adjacent existing development. <br />(V-97) <br />B. Established residential areas shall be protected from intrusion of <br />inappropriate uses and significant adverse impacts of adjacent development. <br />(V-98) <br />This business is comparable to a standard check -cashing business. This shopping center <br />already has an established check cashing business. An additional business will result in an <br />over -concentration of a type of business which will have a negative effort on the retail <br />composition of the shopping center and will detract from the perception of the area. The <br />addition of another check cashing business will be detrimental and injurious to property <br />values and will be detrimental to the public health, safety and welfare. <br />5 <br />
