deductions, the Association may seek enforcement <br />through the courts. <br />2. Service Fee Enforcement <br />The Association shall be responsible for enforcing the <br />provisions of this section using appropriate civil <br />procedures. The City is not responsible for <br />disciplining employees for violation of this section. <br />3. Forfeiture of Deductions <br />If the balance of an employee's wages, after all other <br />involuntary and insurance premium deductions are made <br />in any one pay period, is not sufficient to pay <br />deductions by this article, no such deductions shall <br />be made for that period. <br />4. Financial Documentation <br />a) The Association has presented a demonstration <br />that the legally permissible costs that may be <br />charged as a service fee to a non-member equals <br />somewhat more than ninety-five percent (95%) of <br />dues. <br />The City has not challenged that demonstration <br />and agrees to deduct a service fee equal to <br />ninety-five percent (95%) of dues. <br />b) The Association shall, within ninety (90) days <br />after the end of each fiscal year, make <br />available to the City financial documentation, <br />which shall meet the requirements of Government <br />Code section 3502.2. <br />c) The City agrees to provide the Association the <br />name, department, class, and payroll deduction <br />status of all unit employees on a monthly basis. <br />5. Petition, Election and Challenge <br />a) If a petition is filed with the City which <br />represents an election rescinding agency shop <br />and such petition contains signatures collected <br />within a forty-five (45) day period, of at least <br />thirty percent (30%) of the employees in the <br />bargaining unit, an election will be held. Such <br />election may be held only once during the term <br />of this Agreement. The verification of the <br />petition and the election shall be conducted by <br />State Conciliation Service. Voting shall be by <br />secret ballot, and a majority vote of all <br />3 <br />
