deductions, the Association may seek enforcement through the courts. 2. Service Fee Enforcement The Association shall be responsible for enforcing the provisions of this section using appropriate civil procedures. The City is not responsible for disciplining employees for violation of this section. 3. Forfeiture of Deductions If the balance of an employee's wages, after all other involuntary and insurance premium deductions are made in any one pay period, is not sufficient to pay deductions by this article, no such deductions shall be made for that period. 4. Financial Documentation a) The Association has presented a demonstration that the legally permissible costs that may be charged as a service fee to a non-member equals somewhat more than ninety-five percent (95%) of dues. The City has not challenged that demonstration and agrees to deduct a service fee equal to ninety-five percent (95%) of dues. b) The Association shall, within ninety (90) days after the end of each fiscal year, make available to the City financial documentation, which shall meet the requirements of Government Code section 3502.2. c) The City agrees to provide the Association the name, department, class, and payroll deduction status of all unit employees on a monthly basis. 5. Petition, Election and Challenge a) If a petition is filed with the City which represents an election rescinding agency shop and such petition contains signatures collected within a forty-five (45) day period, of at least thirty percent (30%) of the employees in the bargaining unit, an election will be held. Such election may be held only once during the term of this Agreement. The verification of the petition and the election shall be conducted by State Conciliation Service.
