employees in the bargaining unit shall be <br />required to rescind agency shop. <br />b) A unit employee who is subject to the payment of <br />a representation service fee hereunder has <br />certain legal rights to object to that part of <br />the fee payable by him or her which represents <br />the employee's additional prorata share of <br />expenditures by the Association that is utilized <br />for expenditures not incurred for the purpose of <br />performing the duties incident to effective <br />representation in employer -employee relations. <br />An employee wishing to exercise these rights <br />must contact the Association. <br />6. Hold Harmless <br />The Association agrees to indemnify and defend the <br />City and its officers, employees and agents against <br />all claims, proceeding and liability arising, directly <br />or indirectly, out of any actions taken or not taken <br />by or on behalf of the City under this Section. In <br />addition, the Association shall refund to the City of <br />San Leandro any amounts paid to or upon presentation <br />of supporting evidence. <br />Section 3. Advance Notice <br />Except in cases of emergency as provided in this section, <br />the City Council and boards and commissions designated by <br />law or by the City Council, shall give reasonable written <br />notice to the Association of any ordinance, rule, <br />resolution or regulation directly relating to matters <br />within the scope of representation, including matters <br />subject to consultation, proposed to be adopted by the City <br />Council or such boards and commissions and shall give such <br />recognized Association the opportunity to meet with the <br />City Council or such boards and commissions. The <br />Association shall give reasonable written notice to the <br />Municipal Employee Relations officer of any matter within <br />the scope of representation, including matters subject to <br />consultation, proposed to be communicated to the City <br />Council or such boards and commissions. <br />In cases of emergency when the City Council or such boards <br />and commissions determine that an ordinance, rule, <br />resolution or regulation must be adopted immediately <br />without prior notice or meeting with the Association, the <br />City Council or such boards and commissions shall provide <br />such notice and opportunity to meet at the earliest <br />practicable time following the adoption of such ordinance, <br />rule, resolution, or regulation. <br />4 <br />
