AMENDED AGENDA <br />The Brown Act generally prohibits the City Council from discussing or taking action on <br />an item not appearing on its posted agenda. The Act provides certain exceptions to this <br />rule. For instance, the City Council may, on a two-thirds vote, determine that the need to <br />take action on an item arose after the agenda was posted. If less than five members of the <br />Council are present, the vote must be unanimous. If the Council makes this <br />determination it may proceed to consider the underlying issue presented. Other <br />exceptions are provided for emergencies, as defined, and certain continued hearings. <br />POSTING OF AGENDA <br />The City Clerk is directed to post a copy of the agenda on the notice board outside the <br />East 14th Street main entrance to the Civic Center, not less than 72 hours prior to each <br />regular meeting, and not less than 24 hours prior to each special meeting to be held by the <br />City Council. Notices may also be included on public access or electronic media, such as <br />the City's website and cable television. <br />The agenda shall also be available to the general public by 8:30 a.m. on Friday mornings <br />prior to the City Council Meeting scheduled. Agendas are also available by mail when <br />self-addressed postage paid envelopes are provided. <br />DELIVERY OF AGENDA TO THE CITY COUNCIL <br />If practicable, the agenda and agenda item report packet shall be delivered to Council <br />Members each Thursday afternoon, preceding the Monday meeting to which it pertains. <br />Council Members are asked to advise the City Clerk's Office where they desire agenda <br />packets to be delivered. Holiday schedules may vary. <br />PUBLIC HEARINGS <br />Public Hearings precede Public Comments. Anyone wishing to speak regarding a Public <br />Hearing item may do so at that time. The order of business for public hearings is as <br />follows: <br />1. Staff presentation <br />2. Applicant/Appellant — 10 minutes <br />3. City Council Questions/Clarifications <br />4. Public Comments — 5 minutes per person <br />5. Applicant/Appellant Rebuttal — 5 minutes <br />6. City Council Comments/Questions/Action <br />Council Members should not speak to an issue until the public hearing has been closed. <br />If a Council Member has met with a proponent/developer or opponent of subject hearing, <br />he/she should acknowledge such meeting prior to opening of the hearing at the Council <br />meeting. <br />IV-2 197 <br />
