CITY OF SAN LEANDRO <br />STAFF REPORT <br />DATE: August 7, 1997 <br />TO: John Jermanis, City Manager <br />FROM: June Catalano, Development Services <br />BY: Joann Oliver, Community Standards Coordinator <br />APPROVED AND FORW <br />TO CITY COUNCIL <br />SUBJECT: Community Preservation Appeal - 1862 Edgehill Court <br />SUMMARY AND RECOMMENDATION <br />In response to several complaints and a petition, the Community Standards Section took <br />enforcement action to require the removal of two limousines parked in front of the residential <br />property located at 1862 Edgehill Court. Staff determined that the use of the public street for the <br />daily parking of two limousines was out of harmony with the standards of the neighborhood and <br />caused a public nuisance in violation of the Community Preservation Ordinance. <br />The property owners did not remove the limousines and on July 16, 1997, a hearing was held <br />before the Community Preservation Hearing Board. The hearing board found the condition to be a <br />public nuisance and required the removal of one limousine by August 1, 1997, and the second <br />limousine by July 16, 1998. The Board indicated that the limousines could be parked at the <br />property, if they were parked on a legal off-street parking area. On July 22, 1997, the property <br />owners, Mr. and Mrs. DeLaCruz, filed an appeal of the hearing board's decision. <br />Based on the concern expressed by the neighborhood, staff is continuing to recommend that the <br />limousines be removed. Staff recommends that the City Council require the removal of the <br />limousines within 30 days, based on the following finding: <br />A reasonable determination can be made that the use of the public street for <br />the purpose of parking two stretch limousines is so out of harmony with the <br />standards of the properties in the vicinity so as to cause substantial <br />diminution of the enjoyment, use and property values of such properties, <br />and therefore violates Section 3-1-205(b)(1) of the Community <br />Preservation Ordinance. <br />E <br />
