CU-97-2 Evan's Brothers Appeal 4 10/13/97 <br />reduced by 6 dBA to 9 dBA per doubling of the distance from the source by spherical spreading of <br />the sound wave (General Plan page D41). In this case, the 3,000 foot distance from the source to <br />the closest homes would reduce the noise to below the ambient noise level for those residents. <br />Traffic: Trucks presently double park on Davis Street --especially the metal salvage yard on the <br />north side of Davis Street —making it difficult for the additional trucks to go up and down Davis <br />Street to serve this site. This problem may continue to exist until Davis Street is widened or other <br />traffic measures are imposed. The truck traffic from this use may encounter delays at times because <br />of thus problem. <br />CONFORMANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT <br />(CEQA) <br />A Negative Declaration was prepared for this project and sent to the State Clearinghouse for a 30- <br />day review period. The following issues are identified in the Negative Declaration: <br />View of the Site from Oyster Bay Regional Shoreline Park - The site is on the east side of the park. <br />The stockpiles of asphalt and concrete and some of the larger pieces of equipment may be visible <br />from portions of the easterly edge of the park. However, the main portion of the park faces the bay <br />and the subject property is not visible from those locations. <br />Dust Control - This operation may create dust. The crushing and conveyor system will be provided <br />with water misters and foggers. A water truck will also be used to control dust on the site and a wet <br />rack will be used to control dust from trucks entering and leaving the site. The facility will need a <br />Permit to Operate, issued by the Bay Area Air Quality Management District, which will have <br />stringent dust control requirements. <br />Noise Generation - The noise generated by this operation will be below the ambient noise level in <br />the area as explained above. <br />Transportation and Circulation - The applicant estimates an average of 25 truck trips per day <br />between the hours of 7:00 a.m. and 6:00 p.m. This number could double on an occasional busy <br />day. The low number of truck trips will have an insignificant impact during the a.m. and p.m. peak <br />hours. <br />CONCLUSION <br />The Board felt that this type of use is necessary for communities to meet their state mandated <br />recycling goals of 50% by the year 2000 under AB 939. However, they were concerned about dust <br />and dirt being deposited on Davis Street by trucks, noise impacts and adding truck traffic to Davis <br />Street, which they felt is currently impacted by large numbers of trucks. <br />The Board could not make the findings that this use would not be detrimental to properties or <br />improvements in the vicinity and that it would not create adverse impacts on traffic. <br />The Board of Zoning Adjustments denied CU-97-2. <br />
