18 6547 EBDA BOB ROCKE'IT <br />boos. <br />1 February 1, 1978, and amended March 26, 1981, and further amended February 18, <br />2 1993, and a subsequent Agreement dated June 20, 1985, and further amended February <br />3 18, 1993, which agreements are collectively referred to as "existing agreements"; and <br />4 WHEREAS, the LAVWMA member agencies amended theirjoint powers agreement <br />5 on September 10, 1997, to provide for an export pumping and pipeline expansion project <br />6 which will increase the total design capacity of the LAVWMA pipeline system to 41.2 Peak <br />7 Wet Weather Flow (PWWF) ("Export Expansion Project") ; and <br />8 WHEREAS, LAVWMA's Peak Wet Weather Flow shall be defined as the <br />9 instantaneous rate of flow in MGD measured at LAVWMA's monitoring station located <br />10 approximately one mile north of EBDA's Oro Loma Pump Station; and <br />11 WHEREAS, EBDA has represented that it has capacity to accommodate the <br />12 proposed increase in effluent from the LAVWMA system on an interruptible basis subject <br />13 to the terms and conditions of this agreement; and <br />14 WHEREAS, EBDA is willing to accommodate and provide services for an increase <br />15 on an interruptible flow basis subject to the conditions set forth in this Agreement and; <br />16 WHEREAS, LAVWMA represents that it has the authority to enter into this <br />17 agreement, and shall not take any action in modifying its joint powers agreement or any <br />18 other action that would attempt to diminish or alter its obligations set forth in this <br />19 Agreement; <br />20 NOW THEREFORE, the parties agree as follows: <br />21 LAVWMA Discharge into EBDA system. <br />22 <br />LAVWMA shall have <br />23 the right to discharge a total of 41.2 MGD PWWF into the system, which consists of firm <br />24 capacity of 19,72 MGD and 21.48 MGD interruptible capacity.
