After presentation of the staff report and recommendation, receiving public testimony and <br />discussion, the Board was unable to make the finding that the proposed use would not be <br />detrimental to surrounding properties and would not create adverse impacts on traffic. The Board, <br />therefore, denied the conditional use permit. The item has been appealed by Richard E. Winnie, <br />representing the property owners, Bay Side Partners. <br />Since the July 3, 1997 Board meeting, the property owner applied for Nationwide Permit to fill 0.14 <br />acres of isolated wetlands in the central portion of the rear half of the site. The permit has been <br />issued by the Department of the Army and is valid until December 13, 1998. The property owner <br />has applied for a Grading Permit from the Engineering and Transportation Department. <br />Development Services Department staff has prepared a Negative Declaration that has been sent to <br />the State Clearinghouse for a thirty -day review period. At the completion of the review period, any <br />comments will be addressed and if there are no significant environmental impacts that cannot be <br />mitigated, the Grading Permit will be issued. This will permit Evan's Brothers to place crushed <br />asphalt and concrete as fill on the property.
