matter to the Planing Commission because of the extensive public interest. <br />On June 9, 1977, the Planning Commission modified the approval of SD-75- <br />44 by adding several conditions. The new conditions included a modified circulation <br />plan and a sliding gate across the Harold Avenue driveway so as to effectively prohibit <br />vehicular ingress from Harold Avenue, or pedestrian access to or from Harold Avenue. <br />The Planning Commission action was appealed by the residents of Harold <br />Avenue and the matter was heard by the City Council on July 5, 1977. The City <br />Council upheld the appeal and revolted the original Site Development Permit. This <br />action required the closure of the exit. <br />On August 1, 1977, the City Council delayed enforcement of the revocation to <br />September 6, 1977. On September 6, 1977, the City Council moved to delay the <br />matter for two more weeks to allow meetings with the homeowners in the area. The <br />City Council minutes from September 19, 1977, reference a recommendation for a <br />"workable solution" that would be acceptable to both parties. The specifics of the <br />"solution" were not detailed. However, the record shows that the "solution" was <br />approved by the Council. It appears that the compromise included the addition to <br />the driveway of spikes which would allow vehicle exit only onto Harold Avenue. <br />Although the record is clear that there was great concern about the pedestrian traffic <br />from the apartment, there is no record of a means to stop pedestrians from parking <br />on Harold and entering the apartment complex. <br />3 <br />
