On July 2, 1996, the City of San Leandro Development Services Department <br />posted notice of a hearing on July 11, 1996 by the Planning Commission to "consider <br />revocation or modification to site development subcommission approval granted in <br />1975, to permit vehicle and pedestrian access to Harold Avenue from the St. Moritz <br />Apartments at 14744 Washington Avenue." <br />During the Planning Commission's public hearing on the matter on July 11, <br />1996, the Commission considered the findings of the July 5th Staff report and heard <br />testimony. The testimony, detailed infra, may be summarized as follows: <br />Residents of Harold Avenue continue to feel that the combination of vehicular <br />and pedestrian access to the complex via Harold Avenue creates problems of noise; <br />impacted on -street parking; loitering; speeding and increased volume of traffic; litter <br />from both pedestrians and cars; and increased pedestrian traffic. Residents also <br />asserted that there was an increase in illicit activity attributable to the pedestrians <br />using the gate into the complex. <br />Mr. Sullivan maintains that now as in 1975, vehicular access onto Harold <br />Avenue is necessary to provide safe exit from the complex. He also asserts that from <br />1977 until February 1996, he received no complaints from the residents of Harold <br />Avenue or other neighbors of the complex. Mr. Sullivan testified that he reinstalled <br />the tire spikes to prevent two way traffic via Harold Avenue; the pedestrian gate is <br />desirable for the convenience of tenants and requires a key for access; complex <br />
