i <br />j <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 96 - 8 (2690/1009) <br />RESOLUTION MAKING FINDINGS PURSUANT TO SECTION 3-1028 OF THE SAN <br />LEANDRO ZONING CODE, AND APPROVING PD-91-3 PDP FOR ROBERTS <br />LANDING PHASES 2A, 2B AND 3 WITH THE CONDITIONS PROVIDED <br />Recitals <br />The City Council, by Resolution No. 89-41, adopted the General Plan of the City of San <br />Leandro on March 20, 1989; <br />The City Council, by Ordinance No. 91-011, adopted an ordinance which rezoned <br />certain property commonly known as the Roberts Landing area to various designations <br />including open space, open space -special review overlay, and single-family residential -planned <br />development combining special review overlay; <br />A Draft Environmental Impact Report for the Roberts Landing General Development <br />Plan (GDP EIR) was prepared by LSA Associates, Inc. and was circulated for comment in <br />accordance with the requirements of the California Environmental Quality Act, including the <br />holding of public hearings before the Planning Commission on January 30, 1992 and February <br />19, 1992, for the purpose of receiving oral comments, and acceptance of written comments for <br />the required statutory period the GDP EIR was certified as adequate on April 20, 1992; <br />On April 20, 1992, the City Council approved the General Development Plan for the <br />Roberts Landing Residential Development. The General Development Plan included numerous <br />conditions of approval including the mitigation measures identified in the GDP EIR. Many, <br />but not all, conditions required compliance prior to approval of the Precise Development Plan <br />for Phases 2A, 2B and 3. Staff has prepared and submitted to the Planning Commission and <br />the public staff reports which describe why the proposed Precise Development Plan complies <br />with the GDP conditions of approval including the mitigation measures (see staff report dated <br />December 8, 1995.) The staff report also described compliance with the Roberts Landing <br />Initiative. <br />A Draft Supplemental Environmental Impact Report for the Precise Development Plan <br />for Phases 2A, 2B and 3 was prepared by Environmental Science Associates and was circulated <br />for comment in accordance with the requirements of the California Environmental Quality Act, <br />including the holding of public hearings before the Planning Commission on December 14, <br />1995, for the purpose of receiving oral comments, and acceptance of written comments for the <br />required statutory period; <br />On December 14, 1995, the Planning Commission held public hearings, with notice <br />given as required by law, to accept public testimony on the proposed Roberts Landing Precise <br />Development Plan for Phases 2A, 2B and 3. <br />
