n <br />District Agreement No. 4-1653-C <br />(6) STATE has agreed to incorporate above said IMPROVE- <br />MENTS into PROJECT by Contract Change Order. <br />(7) CITY has agreed to prepare design plans, specifica- <br />tions and estimate for IMPROVEMENTS and is willing to pay one <br />hundred percent (100%) cost of IMPROVEMENTS as completed by <br />STATE during PROJECT construction. <br />(8) The parties hereto intend to define herein the <br />terms and conditions under which IMPROVEMENTS are to be con- <br />structed, financed, and maintained. <br />SECTION I_ <br />STATE AGREES: <br />(1) To administer the construction contract change or- <br />der for IMPROVEMENTS and have the PROJECT construction contractor <br />furnish and install IMPROVEMENTS. <br />(2) Upon completion of PROJECT and all work incidental <br />thereto, to furnish CITY with a detailed statement of the costs <br />to be borne by CITY. STATE thereafter shall refund to CITY <br />promptly after completion of STATE's audit, any amount of CITY's <br />deposit required in Section II, Article (2) remaining after ac- <br />tual costs to be borne by CITY have been deducted, or bill CITY <br />for any additional amount required to complete CITY's financial <br />obligations pursuant to this Agreement. <br />(3) To allow CITY to review the contractor's estimate �S <br />to construct IMPROVEMENTS and to allow CITY to comment on IM- <br />-3- <br />
