The provisions of this lease <br />shall govern over any inconsistent provisions of Ordinance 85-039. <br />"Construction" as used herein shall apply to construction, alteration, <br />demolition or repair work, and the laying of carpet and maintenance work, <br />provided, that Private Work Prevailing Wage Requirements shall not apply to <br />maintenance work "Construction" includes all construction of building core <br />and shell, tenant improvements and public works that are within the <br />customary jurisdiction of the construction trades and crafts, whether performed <br />on or off -site. Off -site work, performed by Materialmen, as defined under <br />California Law, is not included in the term "Construction." <br />The Private Work Prevailing Wage Requirements shall not apply to tenant <br />improvements costing less than $50,000.00, nor to tenant improvements for <br />which the initial building permit for such work is issued more than one year <br />after the certificate of occupancy is approved on the core and shell. The <br />$50,000.00 cost shall be adjusted annually pursuant to the CPI. <br />The following provisions of this subsection apply only if, and to the extent <br />that, the prevailing wage requirements are applicable. <br />The prevailing wage requirements shall apply to the employees of any employer <br />including the Lessee, any tenant of Lessee, any general contractor or <br />subcontractor or other contractor engaged in construction for the <br />improvements by the Lessee, including their successors and assignees, but shall <br />not apply to supervisory or managerial personnel or to persons employed in the <br />rental, operation or (in the case of Private Work Prevailing Wage <br />Requirements only) maintenance of the Premises. <br />The Lessee shall cause the provisions of this subsection to be incorporated into <br />each contract and subcontract, and lease agreement which would be subject to <br />this subsection. In the event the provisions are not so incorporated, the Lessee <br />shall be liable to the worker in any action or proceeding for the difference <br />between the prevailing wage rate required to be paid and the amount actually <br />paid to worker, including costs and attorney fees, as if the Lessee were the <br />actual employer. <br />The prevailing wage requirements of this subsection will be monitored and <br />enforced by the City. In addition to any other rights provided by California <br />law to recover compensation, a worker that has been paid less than the <br />prevailing wage rates shall have a right to commence an action or preceding <br />Me <br />
