At least two weeks before the last date Lessee accepts initial bids for <br />construction Lessee shall file with the City a written list of the names of all <br />contractors to whom Lessee has submitted a request for bids. In addition, <br />Lessee shall file with the City the name of each contractor with whom it <br />proposes to contract, together with the names of their subcontractors of all <br />tiers at least five (5) working days before entering into the contract. <br />Lessee agrees to keep or cause to be kept by each contractor and subcontractor <br />an accurate payroll record for each worker employed on work covered by this <br />Paragraph showing all of the information specified in subsection (a) of Section <br />1776 of the California Labor Code. All such payroll records shall be certified, <br />available for inspection and filed in accordance with the procedures specified in <br />subsections (b) - (e) inclusive of Section 1776 of the California Labor Code. <br />In addition, copies of such certified payroll records shall be filed with the City <br />within a reasonable time not to exceed fifteen (15) days from close of payroll <br />by the respective employer. <br />It is understood and agreed that all documents that Lessee is required to <br />submit to or file with the City under this subsection shall constitute public <br />records that shall be available to any member of the public for review or <br />copying in accordance with the California Public Records Act. <br />In the event of repetitive breach of the requirements of this subsection by <br />Lessee, the City shall be entitled, in addition to all other remedies hereunder <br />for breach of the Lease, to appoint at Lessee's expense a special monitor to <br />oversee Lessee's compliance. Fees for said special monitor shall be billed to <br />Lessee, which fees Lessee agrees to pay as additional rent within 10 days after <br />Lessee's receipt of such bill. In the event of noncompliance with the foregoing <br />requirements concerning payroll records which continues for more than ten <br />(10) days after the City gives to Lessee written notice specifying in what <br />respects Lessee must comply, Lessee shall forfeit as a penalty to the City for <br />each worker twenty-five dollars ($25) for each calendar day, or portion thereof, <br />until strict compliance is effectuated. <br />Lessee shall be responsible for complying with Section 1777.5 of the California <br />Labor Code concerning apprenticeable occupations, with respect to all work <br />covered by that section. <br />Except where the context otherwise requires, the definitions of terms and <br />phrases contained in the State prevailing wage law, Sections 1720 et seq. of the <br />California Labor Code, and in the implementing administrative regulations, <br />13 <br />
